Herefordshire cc seek to overturn a ruling which prevented it from granting planning permission for a farm businss to use polytunnels in the county.
The council granted pp in 2008 for tunnels covering 630 acres with 133 acres covered at any one time.A local action group challenged the decision an dthe judge ruled that ther was an error in law as an Environmental Impact assessment was not undertalen.The council now has leave to appeal.
The NFU are backing the appeal through its legal assistance scheme saying that the EIA legislation was incorrectly interpreted by the high court.
The challenge is based on allowing growers to produce locally grown fresh produce for longer and to save the reliance on imports.
The appeal is due tobe heard in November. I shall report back on the findings.
